The Federal High Court in Abuja has ordered the release of Sheikh Sani Abdulkadir Zaria.
The court also awarded ₦4 million in damages for the violation of his fundamental rights.
Justice Peter Lifu said security agencies violated the applicant’s rights.
These include the right to dignity, personal liberty, fair hearing, and freedom of movement.
The case was filed under the Fundamental Rights Enforcement Rules.
Agencies Named in the Case
The suit listed several respondents. They include:
- Economic and Financial Crimes Commission (EFCC)
- Defence Intelligence Agency
- Attorney-General of the Federation
- Jaiz Bank Plc
- State Security Service (SSS)
Court Orders Immediate Release
The judge directed the agencies to release the applicant without delay.
He stressed that continued detention breached the law.
In addition, he referenced both the Nigerian Constitution and the African Charter on Human and Peoples’ Rights.
Bank Restriction Declared Unlawful
The court also addressed the issue of the applicant’s bank account.
It ruled that the restriction placed on the account lacked legal backing.
Therefore, the court ordered the immediate removal of the restriction.
Damages and Apology
The court awarded ₦1 million each against some of the respondents.
In addition, it granted ₦4 million in total damages to the applicant.
Furthermore, the judge ordered the affected agencies to publish a written apology.
This judgment reinforces the role of the courts in protecting citizens.
It also sends a clear message to security agencies.
However, experts say compliance with such rulings remains key.
