Dantani Urges DSS to Uphold Rule of Law, Constitutional Rights

A constitutional lawyer and rights activist, Hamza N. Dantani, has called on the Department of State Services (DSS) to ensure strict adherence to the rule of law and the protection of constitutional rights while carrying out its national security mandate.

In an open letter addressed to the Director-General of the DSS, Dantani acknowledged the agency’s contributions to national security but raised concerns about recent actions that have sparked public debate.

The lawyer commended the DSS for its role in protecting Nigeria from threats such as terrorism, espionage and sabotage.

Under the National Security Agencies Act, the DSS is responsible for preventing crimes against Nigeria’s internal security and safeguarding classified matters.

Its duties also include intelligence gathering, counter-intelligence, preventive security operations and protection of designated officials.

Dantani expressed concern about reports of arrests linked to opinions expressed on social media and other public platforms.

He noted that Section 39(1) of the 1999 Constitution of Nigeria guarantees citizens the right to freedom of expression and the ability to share information and opinions.

According to him, while national security concerns may justify certain restrictions, such actions must remain within constitutional limits.

The letter referenced reports involving several individuals, including social media commentator Sani “Waspapping”, activist Omoyele Sowore, and Ghali Isma’il Abdullahi (“Sultan”), whose arrests reportedly generated public discussion about the role of security agencies.

Dantani warned that perceptions of targeting dissenting voices could weaken public confidence in the institution.

The lawyer also raised concerns about reports suggesting that DSS operatives have sometimes been involved in private financial disputes or loan recovery matters, issues typically handled by civil courts or other law enforcement agencies.

He cautioned that such involvement could expose the agency to allegations of abuse of power.

Dantani urged the DSS to continue prioritising its core responsibilities, including:

  • Intelligence gathering and analysis
  • Counter-intelligence operations
  • Preventive security measures
  • Protection of critical infrastructure and officials
  • Security advisory to the Federal Government

He also emphasised the need to respect constitutional protections covering human dignity, personal liberty, fair hearing, freedom of thought and freedom of expression.

The lawyer said the letter was written in good faith and aimed at strengthening public trust in the security agency.

He urged the DSS leadership to maintain its reputation for professionalism and discipline while operating within democratic and constitutional principles.
