NBA Raises Alarm Over Court Interference in Party Affairs

The Nigerian Bar Association has raised concerns over growing judicial involvement in political party disputes.

The association warned that such actions threaten democracy and the rule of law.

The NBA cited provisions of the Electoral Act 2026.

It stressed that courts lack jurisdiction over internal party affairs.

The association said some legal actions and court orders contradict this provision.

The NBA cautioned lawyers against filing cases that invite courts into party disputes.

It described such actions as abuse of court process and a breach of professional duty.

The association warned that offenders risk disciplinary action before the Legal Practitioners Disciplinary Committee.

The NBA urged courts to avoid political matters clearly barred by law.

It said judges must focus on cases within their constitutional authority.

The association warned against turning courts into tools for political advantage.

The NBA called on the National Judicial Council to sanction erring judges.

It said strict enforcement will protect the integrity of the judiciary.

The association also urged the Independent National Electoral Commission to remain neutral.

It stressed that electoral institutions must act independently and uphold public trust.

NBA President Afam Osigwe said Nigeria’s democracy must not suffer from legal manipulation.

He emphasised that courts must remain arbiters of justice, not political instruments.
